When insurance companies try to close the door on deserving Long-Term Disability (LTD) applicants, Howie, Sacks & Henry LLP partner Brad Moscato opens his door to them. Renowned as a go-to source for all questions related to disability benefits, he recently created an LTD guide for claimants and potential claimants to inform and empower them as they manage permanent disabilities or long-term illnesses. Moscato knows that insurers don’t always make the right call when assessing an application, and he encourages people whose claims are denied not to waste time pursuing an internal review with the company when that is an option. Why did you become a lawyer?
I want to stand beside people who feel overwhelmed and who need support, especially when they’re up against powerful organizations like insurance companies. Many clients come to me feeling like the odds are stacked against them, and understandably so. Being able to offer them steady support, a clear path forward and a sense that someone truly has their back—that’s what drives me. Seeing even a glimmer of hope in those moments reminds me why this work matters.
You have plenty of concrete experience in Long-Term Disability claims. What do you find most rewarding about those cases?
People who are suffering from serious illnesses or life-altering disabilities frequently have limited options when it comes to finding financial security for themselves and their families. When an insurer issues an LTD denial, it is cutting off one of the only viable options they have left. By negotiating a fair settlement or winning a court award for my clients, I play a critical part in helping them get a piece of their future back. Clients suffering from illnesses or disabilities shouldn’t have to bear the burden of financial insecurity just because an insurer is not completely satisfied with the LTD claim.
How will AI impact your area of law?
Many LTD denials are for claims involving “invisible disabilities” that cannot be readily seen or even diagnosed by doctors except through the exclusion of other conditions. AI may be able to unlock previously unknown ways to prove disabling conditions. But we must be vigilant about the use of these tools.
From a legal perspective, AI will not eliminate the need for plaintiff-side LTD lawyers—but it will reshape how we work. The future lies in lawyers using AI as an efficiency tool without sacrificing the personal judgment and advocacy needed in disability law, especially when clients are vulnerable and insurers are not acting in good faith.
How do you make sure you are being the best lawyer for your clients?
I deal with insurers who have looked at a person’s file and made a life-changing decision without getting to know them. In disability and personal injury law, you must make a real effort to get to know the people you are representing. I work for them, so I need to understand what they are going through, what they need and what this case means for their future. When you take time to get to know the person behind the file, you develop a personal stake in the results. And that can make all the difference.
What’s the most important item in your desk drawer?
A pen that works. Rare, valuable, rumoured to exist, but never seen twice.
Do you have any pets?
A chocolate lab named Hunter. She never gives up on a ball—and I bring the same determination to every case I handle.
